This is our Privacy Policy (the “Privacy Policy”) which describes our collection, use, disclosure and safeguarding of personal information about you that we process as part of  your use of and access to our website located at https://clioslegacy.com/ or any other Clio’s Legacy website that displays a link to this Privacy Policy, along with the online auctioning services and e-commerce platform made available by Clio’s Legacy (collectively, the “Services”). This Privacy Policy does not apply to any other website, service, or application of Clio’s Legacy, or any websites, services, or applications linked to or from the Services. In these Terms of Use, Clio’s Legacy is sometimes referred to simply as “we,” “our,” or “us.”

This Privacy Policy is incorporated into and made a part of our Terms of Use, which is a legally binding agreement between Clio’s Legacy and you, so please read them both carefully. By accessing or using the Services, you are expressly agreeing to comply with and be bound by the Terms of Use and our Privacy Policy, as well as all applicable laws and regulations. 

IF YOU DO NOT AGREE WITH THIS PRIVACY POLICY, YOU ARE NOT AUTHORIZED TO USE THE SERVICES AND MUST NOT ACCESS OR USE THE SERVICES. Clio’s Legacy may revise and update this Privacy Policy at any time; please periodically review it, because your continued use of the Services indicates your agreement with any such changes.

1. Scope

We make the Services available for use in the United States. Although the Services are accessible worldwide, they are not necessarily appropriate for use outside the United States. Your use of the Services is governed by our Terms of Use, which (among other things) set eligibility requirements, describe the auction format, and include dispute resolution provisions. This Privacy Policy describes our data practices for visitors, account holders, bidders, purchasers, Donors, and Beneficiary Nonprofits who interact with the Services.

2. Notice at Collection — What We Collect and Why

We collect the following categories of Personal Information, which means information that identifies, relates to, describes, or can reasonably be linked to an individual or household. For each category, we summarize the business or commercial purposes of collection. 

  • Identifiers and contact data
    Examples:  name, username, email, phone, postal address; account credentials.
    Purposes: account registration; participation in auctions; order fulfillment; customer support; fraud prevention; required notices.

  • Transactional data
    Examples: bids, Winning Bids, purchases, items ordered, shipping/pick-up selections, deposits/holds.
    Purposes: operating the auction and sales features; disbursement to or for Beneficiary Nonprofits; tax and accounting.

  • Payment-related data
    Examples: tokenized card/payment instrument; last 4 digits; billing address. Note that we use third-party processors and do not store full card numbers.
    Purposes: process payments; prevent fraud; handle refunds/chargebacks.

  • Identity and verification data
    Examples: date of birth; government ID in limited cases; document images if we request them
    Purposes: eligibility checks; fraud prevention; bid integrity (including deposits/holds).

  • Shipping and fulfillment data
    Examples: recipient name, address, delivery instructions, tracking data.
    Purposes: fulfill Sale Items; facilitate Donor shipping of Auction Items; handle loss/damage claims.

  • User content and communications
    Examples: reviews, messages, emails, customer support tickets.
    Purposes: operate, improve, and promote the Services; resolve disputes; moderate acceptable use.

  • Internet or device activity
    Examples: IP address, device IDs, cookie IDs, pages viewed, referring/exit pages, timestamps.
    Purposes: secure the Services; debug; analytics; measure and improve performance; show or measure advertising.

  • Inferences and profiles
    Examples: profiles based upon your likely interests derived from your interactions with the Services.
    Purposes: personalize content; improve auctions and recommendations; advertising/marketing.

3. Sources of Personal Information

We collect Personal Information directly from you (e.g., account registration, bids, purchases, support), automatically (via cookies), and from third parties, such as payment processors, fraud-prevention partners, shipping carriers, Donors (for Auction Item fulfillment), Beneficiary Nonprofits (e.g., to verify designation and disbursement), and analytics/advertising partners.

4. How We Use Personal Information

We use Personal Information to:

  • Provide, operate, and secure the Services, including auctions, bidding, purchases, payments, deposits/holds, and disbursements to or for Beneficiary Nonprofits;

  • Verify identity/eligibility (§1.4 of the Terms of Use), maintain bid integrity, prevent fraud and abuse, and enforce the Terms of Use;

  • Fulfill orders for Sale Items and facilitate Donor fulfillment of Auction Items (including sharing shipping details with Donors and carriers);

  • Provide customer support and communicate about Listings, bids, Winning Bids, orders, updates, and policy changes;

  • Conduct analytics, measure performance, and improve the Services;

  • Market and promote the Services, including interest-based advertising where permitted;

  • Comply with law, regulatory requirements, tax/audit, and to protect our rights, users, Donors, and Beneficiary Nonprofits.

5. How We Disclose Personal Information  

We disclose Personal Information to:

  • Service Providers/Vendors, including payment processors, cloud hosting, fraud tools, analytics, email and text message providers, fulfillment and customer support vendors. We use commercially reasonable efforts to limit how they use data.

  • Donors and their designees (for Auction Items only), to the extent reasonably necessary to ship, arrange pick-up, or authenticate items; and to Beneficiary Nonprofits to enable disbursement and, where applicable, acknowledgments/receipts.

  • Carriers and logistics providers for shipping and claims-related matters

  • Advertising/analytics partners for measuring performance and (where permitted) targeted advertising.

  • Authorities, regulators, and law enforcement, such as in response to lawful requests, compliance obligations, or to protect rights and safety of Clio’s Legacy, your, a Donor, a Beneficiary Nonprofit or other third party. 

  • Successors/Transferees in a corporate transaction (e.g., merger, acquisition, financing, or asset sale).

We may disclose aggregated or de-identified information that cannot reasonably be used to identify you.

We do not sell your Personal Information.  

6. Children’s Privacy

The Services are intended for adults and not directed to children under 13. We do not knowingly collect Personal Information from children under 13. If you believe a child provided Personal Information, please contact us and we will take appropriate steps to delete it.

7. Data Security

We use reasonable administrative, technical, and physical safeguards designed to protect Personal Information. However, no security measures are perfect, and we cannot guarantee absolute security.

8. Data Retention

We retain Personal Information for as long as necessary to fulfill the purposes described in this Privacy Policy, including providing the Services, complying with our legal obligations (e.g., tax/audit), resolving disputes, enforcing agreements, and maintaining business records. 

9. International Users

If you access the Services from outside the United States, you do so on your own initiative. Your information will be processed in the United States and other locations where our Service Providers operate. By using the Services, you acknowledge any applicable cross-border transfers.

10. Third-Party Services and Links

The Services may link to or integrate third-party websites and services (including payment processors and Donor/Beneficiary Nonprofit sites) that we do not control. Their practices are governed by their own privacy policies. We encourage you to review those policies before providing Personal Information. Your use of the Services is subject to the Terms of Use, including the governing law, informal dispute notice, arbitration agreement, and class action waiver.

We may modify this Privacy Policy from time to time.
